Zero VAT rate (Nullsteuersatz)

The Nullsteuersatz applies 0% VAT to the supply and installation of a solar system where it is built on or near a qualifying building.

What the rate covers

Since the start of 2023 no VAT arises on the supply of modules, essential components and storage, nor on their installation, where the system is erected on or near a qualifying building. Qualifying means residential buildings, public buildings, and buildings used for activities serving the common good.

For systems up to 30 kWp according to the Marktstammdatenregister a simplification applies: the conditions are treated as met without evidence on how the building is used. Above that size the building itself decides, and each building decides separately.

Where it does not apply

A plain commercial hall, a logistics centre or a production building is not a qualifying building. There the standard rate applies, the system is supplied with VAT, and the business recovers it as input tax. That is not a disadvantage but the ordinary operation of VAT: input tax recovery makes the charge neutral for a taxable purchaser.

Mixed-use property needs more care: what governs is the building the system is erected on, and where several buildings sit on one plot each is assessed on its own. A residential block with commercial ground floor and a hall next to it produce two different answers.

What it does economically

For a purchaser without input tax recovery, a private letting or an owners' association for instance, the zero rate lowers the acquisition cost noticeably and is what makes the small-business VAT regime workable, because no recovery is being given up.

For a business with full recovery it mainly changes the cash profile rather than the return: without the zero rate VAT is paid out and reclaimed later, with it the charge never arises.

What this means for a project

In commercial project assessment the zero rate is usually not the case at hand, and that is the point worth hearing early. On a logistics hall the benefit does not sit in VAT but in the input tax recovery that exists anyway.

It becomes relevant where residential use is involved: mixed portfolios, neighbourhood schemes, systems on ancillary buildings of a residential property. Then the question belongs answered per building and stated in the contractor's quote, because it changes the amount that has to be financed.

For the model itself the separation matters: the zero rate acts on the investment amount, not on revenue, and it is independent of the income tax side with depreciation and the Investitionsabzugsbetrag. Merging both into one figure is the most common error in such calculations. This is orientation and not tax advice.
